GENERAL TERMS AND CONDITIONS
1. Scope
(1) These General Terms and Conditions (GTC) apply to all contracts concluded via the website of Alhamra e.K. between the company and its customers.
(2) Deviating conditions of the customer will not be recognized unless Alhamra e.K. expressly agrees to their validity in writing.
2. Conclusion of Contract
(1) The presentation of products on our website does not constitute a legally binding offer but an invitation to place an order.
(2) By submitting an order, the customer makes a binding offer to purchase the products in the shopping cart.
(3) The confirmation of receipt of the order is sent via email but does not yet constitute acceptance of the offer. The purchase contract is only concluded when Alhamra e.K. expressly confirms the order or ships the goods.
3. Prices and Payment Terms
(1) All prices stated on the website are in euros and include statutory VAT unless otherwise specified.
(2) The customer can choose from the payment methods available on the website.
(3) Payment is due immediately upon conclusion of the contract unless otherwise agreed.
4. Shipping and Delivery
(1) Delivery is made to the address provided by the customer.
(2) The stated delivery times are non-binding unless explicitly agreed otherwise.
(3) If an ordered product is unavailable, the customer will be informed immediately. Alhamra e.K. reserves the right to refuse delivery or withdraw from the contract.
5. Right of Withdrawal
(1) Consumers have the right to withdraw from the contract within 14 days without giving any reason.
(2) The withdrawal period begins on the day the customer or a designated third party takes possession of the goods.
(3) To exercise the right of withdrawal, the customer must inform Alhamra e.K. in writing (e.g., by email or post).
(4) The customer bears the return shipping costs unless otherwise agreed.
(5) The right of withdrawal does not apply to sealed goods that are not suitable for return for hygiene or health protection reasons.
6. Warranty and Liability
(1) The statutory warranty rights apply.
(2) Alhamra e.K. is not liable for damages resulting from improper use or natural wear and tear.
(3) Alhamra e.K. is only liable for intent and gross negligence unless it concerns the breach of essential contractual obligations.
7. Retention of Title
(1) The goods remain the property of Alhamra e.K. until full payment has been received.
(2) The customer is obliged to handle the goods with care and to inform third parties about the existing retention of title.
8. Data Protection
The processing of personal data is carried out in accordance with the Privacy Policy of Alhamra e.K., which can be viewed on the website.
9. Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) If any provision of these GTC is or becomes invalid, the validity of the remaining provisions remains unaffected.
